These Terms and Conditions (“Terms”) govern your use of elashdesign.com (the “Site”), operated by Elash Design Studio LLC (“Elash Design Studio”, “we”, “us” or “our”), a design, development and SEO studio based in Los Angeles, California that works remotely with clients across the United States. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Using the Site
You may use the Site to learn about our services, read our content and contact us. You agree not to:
- use the Site in a way that breaks any law or infringes anyone's rights;
- try to gain unauthorized access to the Site, its servers or any connected system, or interfere with its security or operation;
- send spam, malware or misleading information through our forms;
- scrape, copy or republish substantial parts of the Site with automated tools without our written permission.
We may change, suspend or remove any part of the Site at any time.
2. Our services
Information on the Site about our services, process and pricing is general and is not an offer. Any work we do for you is governed by a separate written proposal, statement of work or contract signed by both parties. If that agreement conflicts with these Terms, the agreement controls for the project it covers.
Results from SEO, advertising and design work depend on many factors outside our control, including search engine and platform decisions. We do not guarantee any specific ranking, traffic, lead volume or revenue unless a signed agreement says so.
3. Intellectual property
The Site and its content, including text, graphics, logos, the Elash Design Studio name and design, are owned by us or our licensors and are protected by copyright, trademark and other laws. You may view and print pages for your own personal or internal business use. Any other use, including copying, modifying or distributing our content, needs our written permission.
Ownership of work we create for clients is set by each client's agreement.
4. Portfolio and case-study content
Our portfolio and case studies show work we have done for clients, shared with their permission or as allowed by our agreements with them. Client names, logos, trademarks and website content belong to their respective owners and are shown only to describe our work. Screenshots and descriptions reflect the project at the time it was completed and may not match the client's current website or app. If you are a client and would like something changed or removed, contact us.
5. Messages you send us
When you send us an inquiry or project details, you confirm that the information is accurate and that you have the right to share it. We treat project information you send us as confidential and handle personal information as described in our Privacy Policy. Please do not send passwords, payment card numbers or other sensitive information through our forms.
6. Third-party links and services
The Site links to websites and services we do not control, such as our HoneyBook scheduling page, Google and client websites. We are not responsible for their content, terms, privacy practices or availability. Your use of them is at your own risk and under their terms.
7. Disclaimers
The Site and its content are provided “as is” and “as available”. Articles and guides on the Site, such as our SEO and accessibility guides, are general information, not professional, legal or technical advice for your situation. 8. Limitation of liability
To the fullest extent allowed by law, Elash Design Studio and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to your use of the Site, even if we were told such damages were possible. Our total liability for any claim relating to the Site is limited to one hundred US dollars (US $100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Liability for paid services is governed by the agreement for those services.

You agree to defend, indemnify and hold harmless Elash Design Studio and its owners, employees and contractors from any claims, losses, damages and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your breach of these Terms.
10. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. Before filing a claim, both parties agree to try to resolve the dispute informally by contacting the other in writing.
11. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site.
12. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and change the “Last updated” date at the top. Your continued use of the Site after a change means you accept the updated Terms.
